Probate

Probate is the court supervised legal process necessary to settle property distribution from the decedent to his or her beneficiaries upon death.  The court accepts the will for administration or determines who inherits without a will.

You may have heard horror stories about costly and complicated probates.   Unlike some other states such as California or Hawaii, Washington’s probate process is considerably quicker, simpler and much less expensive.

Still, it’s not easy.  Probate is a court proceeding, and as such there are precise rules, complicated procedures, and time lines that need to be followed.  Courts require that anyone filing a will for probate or seeking appointment as PR know and understand these procedures.

We know that dealing with the death of a loved one is a traumatic event.  Having to deal with probate on top of everything else adds greatly to the stress.  As Elder Law attorneys, we’ve seen many families go through the probate process, and we’ve worked out a system that we believe works closely with our client’s needs and desires.  We make the process as transparent, efficient, and as accessible as possible.

For instance, we assist our client with transferring automobile titles, transferring titles to real estate, gaining access to accounts at financial institutions, and dealing with creditors of the estate.  We make sure the administrator is protected from personal liability.

Sometimes there doesn’t need to be a probate.  We can help determine when this applies.

If the estate involves property in California or Arizona, we can also deal with that, too.  We are licensed in both states.  This can be especially helpful in California where dealing with courts there must be done by experienced legal professionals
